    i called a couple of times spoke to Inf officer at NSC ,

    && she told she was not aware of cases where NSC has created rejection letters and sent them also she added they just completed june filers and will be starting to proceed with JULY .

    Now reg. my processing times:

    Receipt Jul 2 9:54 : FedEx
    status : On Hold ?
    Checks : Not cashed Yet

    She also adviced most probably i should receive some kind of communication before end of july !!

    I disagree with the earlier comment. I don't agree that any one(including EB3) lost due to July 2007 visa bulletin. sure it was haphazard by the way it was handled, but thousands of well qualified applicants from many retrogressed countries had a chance to file their I 485 and were able to obtain well deserved benefits like EAD, AP or themselves and their dependants which thy have been denied for many yearsdue to the inefficient processing of various agencies. people have to realize that all of us are in the same boat and most of the people getting unfair treatment are from the retrogressed countries waiting for their green cards for 8-9 years

    I do beg to differ, nice post but low on facts, its more conjecture and assumptions.
    PHDs - EB1 dont make the kind of cash you have shown (ask the post docs who are working there asses off), similarly EB 3's are not restricted to the range you are talking about.
    Gaming the system is what screwed us, its not just EB3 its every where. The ones who gamed the system already have their GCs. The extent of gaming in EB1 and EB2 was more than EB3 (ask a lawyer, off the record and you will know). Bodyshopping companies send every one as project managers and they apply in EB2. as for experience, lets not get into that, it is very subjective and vague. I could go on and on...but my level of frusturation with USCIS is too high...hoping and praying is also not an option these days.

    Here are the few main reasons for retrogression to India and China etc are

    1) When H1B quota is 65, 000 the GC visa number is 140, 000 . But when they increased H1B from 65,000 to 195,000 the did not incresed GC visa numbers.

    2) There is no country quota in H1B ( other than Chile and one more country for 7,000) visas. So most of the H1b's are issued to few countries like India,China and Philippines. But when we come to GC visa there is country quota.
    3) We all know about that ilegal immigrants used some GC numbers which are meant for EB people.

    We need to educate the USCIS why and how we are suffering in getting GC.
    there is no need and use of blaming Desi companies. I do not support any illegal activities like sale of Labour certifications .
    We all know about supply and demand theory which causes black marketing.
    Selling of approved labour ( which has old PD ) is also same thing.

    Hey guys, thanks for the replies and the good advice, which helps a lot. It's true that prevailing wage for H1b and CG are different, so I don't think my employer is breaking the law...at least not yet. (Logiclife, what do you think? Wouldn't the attorney had told them that they are breaking the law?) It's just a hard reality check to realize that all the "we care about our employees" is just a smoke screen.

    They do care about employees. They just can't handle immigration and visa issues. It is too complicated for a lot of employees. For a lot of employers, the term H1b visa or sponsership gives "jitters".

    While a lot of employers look at things from their perspective, they do understand all issues that you face. It all depends on how important you are and if your absence would make a difference. If you are irreplacable, and employer thinks they must keep you at any cost, then they will do it, or you have to take care of yourself.

    here are my 2 cents..

    its nice to talk endlessly about what went wrong and bitch about it till the morning. one thing we all need to realise is this : we are going to have failures. period. just like we have had failures in the past. this is not going to be easy where you win every single legislation. 10% hit rate is success enough given the opposition and difficulties we face. so now, given that our batting average is going to be low, the question is this : everytime we have a failure, if people are going to sit on their butt, smoking their pipe dreams and doing monday morning quarterbacking about what part was wrong, then shouldn't they also volunteer to their local IV section to make it better? lets face it, if you really think something can be done better, then volunteer to the local IV branch and do it. everybody can benefit. but if all you are going to be doing is sitting here and posting negative messages, then you hurt everybody, starting with you. the opposition is much better organized, has more money and has great influences on the political inside. if you are not providing any constructive or organizational help, causing people to be distracted and causing IV core to lose their focus, and if you are not willing to volunteer to make it better, then in my opinion its best to step aside, be quiet and let the people in charge do it. again, if you are not helping, then you hurt everybody starting with you.

    in this case, like paskal mentioned, if you think the phone calls were not important, then you haven't seen the victory message from numbersusa where they talked about the deluge of phone calls that were made by their supporters and how crucial it was in throwing out the visa recapture amendment. if anything, perhaps we could have gotten better organized with the calls. But I suspect things also moved much faster than anyone anticipated, including IV core.

    lets focus our energies and support IV core and ourselves.

    The point is what did we lose by calling. It took us a call which any way is free. Took 2-3 minutes of our time which other wise we were not planning to use in any other better activity. So even if the campaign fails ( I pray it does not) still we havent lost finacially or in any way. Atleast it brought so many people together to do something constructive. Made people understand how a bill works in senate.

    To your other point that senetors do not care about non voters then then the only other way is lobbying and paying for campaign funds. Can we do that the answer is plain NO. Most people on H1B are working for blod sucking consultants who pa them far less than what they deserve. How much can they contribute financially if they have dependent wife an kid here and parents in home country. Add to this the job insecurity in current market and there is no guarranty that paying one time will bring any results. Least this way every one contributes.

    [Mr. Brown] True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.


    [harikris] Plan B/C comes into play when plan A is logically terminated. That is not the case here Mr. Brown. The process should be fast enough not to allow a life changing event to weigh in on any individual to continue with an initially chosen plan or to abandon it.

    [harikris] I am referring to the statements that USCIS/legislators make when they come up with yet another innovative method to overhaul the system to speed up the process and efficiently tackle the existing backlog within a pre-set target date. We have to take their word for it, if we are to have any solid grounds for making a case against backlogs. We got to STOP taking their statements with a "pinch of salt" and "wink-wink" fashion because that would mean we have lost the fight even before we enter the field. We got to "help" USCIS and work with them so that they can help us.


    [Mr. Brown] You nailed it. I completely agree with you and guess what this arrogance from USCIS will come back to bite them but it will be too late. How do you think empires that rule for centuries crumble in a few years? Empathy (or lack-thereof) can bring one down to their knees.

    We all will have to work to make the injustice visible; only then will the employers start behaving.

    We all remember there used to be a IV voice member who used to leave abusive comments to everybody. Once we all made a hue and cry about this Pappu took action against him by disclosing his identity and since that day we have not seen any complaints by members.

    Yes. That member and probably other such members are now on other site posting anti-IV posts.....

    It is shameful to have such members among us.

    Anyways, good thread. This site should help people fix the broken system rather than abuse each other or track all day. I hope due to the discussion, people can get some ideas and take action against such employers. IV will be willing to help as needed.

    With regular quota of 3000 per year EB3I (until July 2007) will be cleared in next 20+ years.
